bbSlate Terms and Conditions
1. DEFINITIONS
For the purposes of these Terms and Conditions:
- Account means a unique account created for You to access the bbSlate Application.
- Application Store refers to the digital distribution platforms operated by Apple Inc. (Apple App Store) and Google Inc. (Google Play Store) where the Application is made available.
- Best Brains refers to Best Brains, Inc., 135 E. Algonquin Road, Suite B, Arlington Heights, IL 60005.
- bbSlate or Application refers to the mobile application developed by Best Brains for homework submission and feedback.
- Device means any device that can access the Application, including computers, tablets, or smartphones.
- Terms and Conditions ("Terms") refer to this agreement between You and Best Brains governing the use of bbSlate.
- You (or "Your") refers to the individual using the Application, either as a student (ages 3–14), a parent/guardian acting on their behalf, or internal staff of Best Brains.
2. ACKNOWLEDGEMENT
By accessing or using bbSlate, You agree to be bound by these Terms and Conditions. If You do not agree to any part of these Terms, You may not use the Application.
You affirm that if You are under 18, Your use of the Application is authorized and supervised by a parent or legal guardian. Use of the Application by children under 13 requires verified parental consent in compliance with COPPA.
3. USER ACCOUNTS
User accounts for bbSlate are created and managed by Best Brains. These accounts are distributed to parents or students for educational use. You agree to use your account solely for its intended purpose and not to share credentials with unauthorized users.
4. DATA PRIVACY & USAGE
bbSlate collects and uses limited personal data, including student names, assignments, and voice recordings (when explicitly permitted). This information is used only to facilitate homework submission and provide educational feedback.
All data is handled in accordance with Best Brains' Privacy Policy, and is never sold or shared with third parties.
5. INTELLECTUAL PROPERTY
All content, features, and functionality within bbSlate are the property of Best Brains and its licensors. You may not reproduce, distribute, or create derivative works based on any portion of the Application without prior written consent.
6. USE LIMITATIONS
You may not:
- Use the Application in any manner inconsistent with its educational purpose;
- Upload inappropriate or offensive content;
- Tamper with or attempt to access accounts other than your own;
- Use bbSlate for any commercial or unlawful activity.
7. FEES AND PURCHASES
There are no in-app purchases or payment features within bbSlate. Monthly program fees are collected directly by the respective Best Brains centers and not through the Application.
8. APP STORE TERMS
Use of bbSlate is also subject to the applicable terms of the Apple App Store and Google Play Store.
9. TERMINATION
Best Brains reserves the right to suspend or terminate access to bbSlate at any time, with or without notice, for violations of these Terms.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Best Brains shall not be liable for any indirect, incidental, or consequential damages arising from use or inability to use the Application. In no case shall liability exceed $100 USD or the amount paid for use (if any).
11. “AS IS” DISCLAIMER
The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. Best Brains disclaims all implied warranties including fitness for a particular purpose, accuracy, and non-infringement.
12. COMPLIANCE WITH LAWS
You agree to comply with all applicable laws, including those related to privacy, children's online safety, and educational data. Users under 13 may only use the Application with verified parental consent in accordance with COPPA.
13. MODIFICATIONS
Best Brains may revise these Terms at any time. Continued use of bbSlate after such changes constitutes acceptance of the new Terms.
